Creationism is a Bible–based view of human origin that states humans were created in their current form and have not changed, or evolved, throughout the years. However the belief that our species has changed over time to suit our environment is considered evolution. As both sides possess strong evidence for their conclusions, the debate that stemmed many years ago, even before the famous Scopes trial, has no end in sight. Recently state education boards in Kansas, Alabama and Kentucky have given school districts the opportunity to decide for themselves whether creationism will be taught, along with evolution, in their classrooms. Furthermore, the state of Colorado has dropped all questions on their standardized tests that pertain to evolution. Conversely, on October 8th, 1999 '…the New Mexico Board of Education voted overwhelmingly… to limit the statewide science curriculum to the teaching of evolution'; (Janofsky 1). Creationists refer to the Bible to explain that the creator developed the universe, including Adam and Eve. But, creationists also use science to disprove the theory of evolution. Through the second law of thermodynamics, which states that a system is always heading towards disorder, creationists explain that there was once a time when the universe was more orderly and that singularity existed approximately 15 billion years ago. If this is true, where did this singularity come from? Creationists believe that only a superior creator could have set forth this condition. Although evolution is only a theory, it is widely accepted and is based solely on scientific data. Through the second law of thermodynamics evolutionists believe that humans should continue in a pattern of disorder as are those things neglected in a system. However, humans have become more orderly and more suited for their environment, clearly a process that is carried out by gradual change over time. Through Charles Darwin's The Origin of Species, published in 1859, the world was introduced to natural selection and the theory of evolution. In his autobiography, Darwin states 'It was evident that such facts as these, as well as many others, could be explained on the supposition that species gradually become modified'; (118-119). This type of thinking in his times was extremely radical and unheard of, but throughout the years evolution has been explored further and accepted by most scientists. Fair Labor Standards Act

Today we are fortunate to have laws to protect us from being forced to work excessive hours without being fairly compensated. We have laws to protect our children from being forced to work at an early age and these laws protect us from working in unsafe and unhealthy conditions. In 1938 our 32nd president Franklin D. Roosevelt was able to have the â€Å"Fair Labor Standards Act† passed and signed into law. This piece of legislation was a land mark in our history.It banned most child labor; it set a minimum hourly wage and set the standard work week. This was the beginning that made employers develop records to keep track of the wages that they paid to their employees and records of the hours the employees were working. The Supreme Court had been one of the major obstacles to wage-hour and child-labor laws. In the 1936 Presidential race wage-hour legislation was a campaign issue and Roosevelt promised to seek some constitutional way of protecting workers.When President Franklin D. Roosevelt won the 1936 election by a landslide he was determined to overcome the obstacles of the Supreme Court’s opposition as soon as possible. Roosevelt and his Secretary of Labor, Frances Perkins tried to make a model for employers of government contractors in all fields, not just construction. But the Federal Government actually encouraged employers to exploit labor because the Government had to award every contract to the lowest bidder.President Roosevelt and Frances Perkins continued to try to get congress to pass acts to prohibit the labor of children and set minimum wages and hours. The â€Å"Fair Labor Standard Act† in a draft form was sent to the White House where two trusted legal advisers of the President, and with the Supreme Court in mind, added new provisions to the already lengthy bill. Roosevelt had told his Secretary of Labor, that the length and complexity of the bill caused some of its difficulties with Congress, and asked for it to be shortene d.Lawyers tried to simplify the bill but faced the problem that, although legal language makes legislation difficult to understand, bills written in simple English are often difficult for the courts to enforce. Because the wage-hour, child-labor bill had been drafted with the Supreme Court in mind, the bill could only be cut from 40 pages to 10 pages. The bill was voted upon May 24, 1938 and after the House had passed the bill, the Senate-House Conference Committee made more changes to reconcile differences.During the legislative battles over fair labor standards, members of Congress had proposed 72 amendments. Almost every change had exemptions, narrowed coverage, lowered standards, weakened administration, limited investigation, or in some other way worked to weaken the bill. What had survived was approved by the conference committee and passed the House on June 13, 1938 and then the Senate approved it. Congress then sent the bill to the President, and on June 25, 1938, the Presid ent signed the Fair Labor Standards Act into law. This affected industries that employed about one-fifth of the US workforce.About 700,000 workers were affected by the wage increase and 13 million more were affected by the hour’s provision. It mostly affected white males, and about 14 percent of women (http://www. u-s-history. com). Children under the age of fourteen were no longer legally allowed to work with some exceptions in the agricultural industries and family businesses. Children under the age of eighteen were banned from working â€Å"hazardous† jobs in mining and some factory jobs. This had greatly reduced the number of children injured by bad working conditions.Children between the ages of 14 and 16 have had additional restrictions on the number of hours they are allowed to work to encourage them to stay in school. During a school day they are only allowed to work three hours and no more than eighteen hours in a school week. Children are not allowed to work before 7a. m. and after 7 p. m. , and from June 1 through Labor Day they are not allowed to work after 9 p. m. The 14 and 15 year old also have addition al restrictions in addition to the â€Å"hazardous† jobs that they may not perform.These jobs include the food service industry such as baking, cooking, working in the freezers and meat coolers, operating food slicers, grinders, choppers and bakery mixers. Fourteen and fifteen year olds are also not to perform jobs that require loading or unloading goods on or off of trucks, railcars or conveyors and they are not to work in connection with maintenance or repair of buildings, equipment or machines. Employers may be assessed civil monetary penalties of up to $11,000 for each employee who is the subject of a violation of the Act’s child labor provisions.A civil monetary penalty of up to $50,000 may be assessed for each child labor violation that causes the death or serious injury of any minor employee, and these assessmen ts may be doubled, up to $100,000 when the violations are determined to be willful or repeated (LindenMeyer, 2004). In the â€Å"Fair Labor Standard Act† the federal minimum wage began at 25 cents per hour in 1938 and it has had over twenty amendments made over the years for increases. The latest rate of $7. 25 per hour was effective on July 24, 2009.In addition to a minimum wage employers must pay the employee’s wages in cash or something that can easily be converted to cash or legal forms of compensation, for example food and lodging. Employers cannot pay their employees with coupons or tokens that can only be used in a store owned by the employer. Discounts that are granted to employees by the employers cannot be used towards meeting the minimum wage requirement. There are a number of employment practices which ‘Fair Labor Standard Act† does not regulate.They are vacation, holiday, severance, or sick pay; meal or rest periods, holidays off, or vacations; premium pay for weekend or holiday work; pay raises or fringe benefits; or a discharge notice, reason for discharge, or immediate payment of final wages to terminated employees. The standard work week in 1938 was reduced to 44 hours per week, and if employees were to work over that they would be paid over time at a rate of their wages plus one-half wages for the additional time worked. By 1940 the standard work week was reduced to 40 hours per week (www. dol. gov/dol/oasam/programs/history/flsa1938. htm).Despite this law in 2006 a class action law suit was brought against Wal-Mart for not paying its employees for their overtime and forcing them to work through their breaks. Wal-Mart lost the law suit and the workers won $78. 4 million (Worth 2008 p 12). In 1961 an amendment was added to the â€Å"Fair Labor Standard Act† called â€Å"enterprise coverage†. It applies to employers whose annual sales total $500,000. 00 or more, or who are engaged in interstate commerce. The courts interpreted that the term interstate commerce to cover companies that regularly use the U. S. mail to send and receive letters to and from other states.The courts included that employees that use company telephones or computers to place or accept interstate business calls or take orders would make the employers subject to the â€Å"Fair Labor Standard Act† (Steingold, 2009). There are also exemptions to the â€Å"Fair Labor Standard Act† where some employees do not qualify for the provisions of overtime or the minimum wage requirements. These employees who are not entitled to it are called â€Å"exempt† employees. Employees that are always entitled to the overtime and the minimum wage pay provisions are â€Å"nonexempt† employees and they are blue-collar employees and first responders.Blue-collar employees include carpenters, electricians, mechanics, plumbers, iron workers, craftsman, operating engineers, construction works, and laborers. First responders are workers that are on the front lines of protecting safety and health. They include police officers, firefighters, medical technicians, ambulance personnel, and hazardous materials workers. Employees that are always exempt and are never entitled to overtime or a minimum wage are employees of seasonal amusement or recreational businesses, employees of newspapers with a circulation of less than 4,000 and newspaper deliver people, and workers of small farms.Some employees are exempt if they meet certain requirements; this is usually because the employees are being paid a salary that compensates them enough for the extra duties and responsibilities that they have. Executive, administrative and professional workers are exempt if they meet the specific guidelines. The requirements for an exempt executive worker are that they must manage other workers as a primary job duty and have at least two full time employees that they are in charge of. They must have the ability to hire , fire, discipline, promote, and demote others or make recommendations about these decisions.The executive worker must earn a salary of at least $455 per week. The requirements for an administrative employee to qualify as exempt are that they must primarily complete their work directly for the business’s management or administration. They must be independent workers and primarily use their own discretion and judgment on their work duties. The administrative employee also must earn a salary of at least $455 per week. The requirements for an exempt professional are that they complete work that requires invention, imagination, originality, or talents in the arts such as music, writing and acting.They may need to be a highly intellectual and have been trained in extensive studies such as law, medicine, theology, accounting, engineering, architecture, teaching, and pharmacy. The must also earn a salary of at least $455 per week. Outside sales people are exempt if they regularly wo rk away from the employers’ office and make sales or obtain orders or contracts for services or facilities. Exempt salespersons are generally paid through commissions and will require little to no supervision to complete their job.The exemption from the minimum wage and overtime pay provisions also applies to computer specialist that receives a salary of at least no less than $455 per week or not less than $27. 63 per hour. The law specifies that computer specialist’s primary duties involve applying systems analysis techniques and procedures. Designing, developing, documenting, analyzing, creating, testing, or modifying computer systems or programs, prototypes and/or machine operating systems. There are a number of employees that are exempt from only the overtime pay requirements.These include taxicab drivers, announcers, news editors, and chief engineers of radio and TV stations that have fewer than 100,000 people located in a town or city (Repa, 2007 and Steingold, 2 009). In 1963 an amendment called the â€Å"Equal Pay Act† had been added to equalize the pay scales for men and women who work at an equal skill, effort and responsibility. Congress felt that the differential in pay prevented the maximization of the available labor resources, they wanted to prevent labor disputes, and they did not want an unfair method of competition.They also felt that the wage differentials depressed the wages and the standard of living. Congress also wanted to eliminate stereotypes about the value of work performed by women. Congress exempted several forms of discrimination from the operation of the Equal Pay Act. These exceptions include shift differentials, restrictions on or differences based on the time of day worked, hours of work, and the lifting or moving of heavy objects. The Equal Pay Act also excluded differences based on experience, training or ability, as well as unusual or higher than normal wage rates which employers maintained for valid rea sons.The Equal Pay Act allows for unequal pay for equal work only when wages are set pursuant to a seniority system, a merit system, a system which measures earnings by quantity or quality of production, or other factors outside of sex (The Bureau of National Affairs, Inc, 1963 and Landsberg, 2004). In 2004 a class action suit was brought against Wal-Mart were 1. 6 million female associates that worked for Wal-Mart felt that they were discriminated against because they were women. These women tried to advance into higher paying positions but were passed over by men/boys who did not have the experience and knowledge that these women had.More than seventy percent of the Wal-Mart workforce is women, sixty-five percent of the cashier and greeter positions are held by women and only thirty-five percent of the assistant managers for Wal-Mart are women. The female employees of Wal-Mart are paid less than the male workforce for jobs that are of equal skill, effort and responsibility all for keeping prices lower for the consumer (Worth, 2008 p 8-12). The Fair Labor Standard Act requires employers to keep records of wages, hours, and other regulated items by the Department of Labor.Most of the information is generally obtained by employers in ordinary business practice and in compliance with other laws and regulations. Employees that are subject to the minimum wage provisions or both the minimum wage and overtime pay provisions must have employers keep the following records with personal information, including employee's name, home address, occupation, sex, and birth date if under 19 years of age, the hour and day when workweek begins and the total hours worked each workday and each workweek.These records also need to indicate the total daily or weekly straight-time earnings and the regular hourly pay rate for any week when overtime is worked and total overtime pay for the workweek. In addition to records for hours worked and paid the records also must include deduction s from or additions to wages, total wages paid each pay period and the date of payment and pay period covered. The Records required for exempt employees differ from those for nonexempt workers. The constitutionality of the â€Å"Fair Labor Standard Act† was unanimously supported by the Supreme Court it has been altered and amended on at least 43 occasions between 1938 and 2009. Those alterations and amendments have provided and clarified benefits to workers in various employment sections, and made increases to the minimum wage. As a hardworking American we have a right to be paid fairly for our work. It is unfortunate that many unscrupulous employers attempt to manipulate laws intended to protect workers in order to avoid paying just compensation.When this happens, employees can turn to the legal system to ensure that their rights are protected without being discriminated against or discharged for filing a complaint or participate in any proceeding under the Act. ? My Hobby- Kayaking Essay

Ladies and gentlemen, I have come here to talk to you about one of my hobbies, kayaking. A common misconception is that a kayak is the same as a canoe, but this is not the case. There are a number of differences between a kayak and a canoe, the main difference is that in a kayak, you are enclosed, unlike in a canoe, whose cockpit is much like a boat. Also, a kayak is normally for one person only and a canoe is for a number of people. Finally, in general, a canoe has only one paddle. While a kayak has two that are joined together with one shaft. The word kayak means â€Å"hunter’s boat†. The kayak was developed by cultures in the arctic of North America for hunting. To these people, the kayak meant survival. Without it they couldn’t get food. There wasn’t much time for recreation. To obtain food they used kayaks to hunt in extremely harsh conditions. Archaeologists have found evidence that indicates kayaks to be at least 4000 years old. Hunting in a kayak was very dangerous. Sometimes a wounded animal wound attack the kayak, and walrus and whales were especially dangerous when injured. Occasionally the harpoon line would tangle and damage the kayak. Because the escaping normally was so hazardous, these people became quite proficient in the â€Å"Eskimo Roll† (where if you get flipped upside down, this is called capsizing, you flip yourself up again instead of exiting the kayak). The reason for this is that in emergencies, exiting the kayak into the water was very perilous; the animal that they were trying to hunt could be even more dangerous if they were attacked while inside of the water. Rolls that are thought of as tricks now were based on actual survival techniques. The hunter may have been hurt by a wounded animal or have their hand tangled in the harpoon line, and therefore the Eskimo roll is essential to avoid drowning These paddlers used jackets made from waterproof skins and seal intestines. Today, these waterproofs are also used as well, they are called cagoules,  but they are fortunately made of fabric! I like kayaking because it gives you a sense of freedom. The fresh air and water can be very refreshing and relaxing. A great thing about kayaking is its great diversity. The number of things that you can do and the many ways that you can do it is overwhelming. You can go with as many or as little people as you want. You can go in almost any weather as long as you wrap up warm in colder circumstances. You can do tricks such as the Eskimo roll. You can race your friends and even play games such as bulldog. Finally you can go on long sightseeing tours. The scenery is frequently breathtaking, you can get close to wildlife such fish swimming and it is not uncommon to see the adorable sight of a duck and a line of chicks following its mother. There is a large sense of satisfaction when you get better or learn something new. Today, these hunters have replaced their kayaks with motorboats, but kayaking has become a very popular form of recreation in other parts of the world. Today’s kayaks are mainly made of plastic and wood. Their design runs from small white-water boats to 20 foot long touring kayaks that can carry several week’s provisions. The reasons we paddle may have changed, but the kayak remains a quiet, efficient and fun means of transportation whose design has stood the test of time. Thank you for listening

Allah, the God of Islam, is seen as a god that does not tolerate injustice and seen as a leader who is the protector of the oppressed and punish non-believers. Seeing the damages that the war in Israel and in Afghanistan brought to the Muslim, Osama has taken the lead in calling for the Muslim people to uphold Allah’s laws and fight off the injustice deeds of the powerful conquerors. Martyrdom The goal of fighting off non-Islamic factions has instilled an image of a ruthless oppressor due to the Muslims’ experience under the hands of western groups that has a completely different belief from them. As terrorist groups have been established, members are always being reminded about their purpose through indoctrination. Leaders of the group would often read the scriptures from the Quran, retells the heroic acts of the Islamic wars; and most importantly if they are to prepare for a suicide mission, the leaders reminds them Allah’s will of self-sacrifice and the rewards that awaits them in paradise after death (Bongar, Brown, Beutler, Bongar, Zimbardo, 2007, p. 110). Martyrdom is not a duty to be followed, it is embraced by the members wholeheartedly and waiting for it with anticipation. The act of a suicide attack is a manifestation of the martyrdom. For the Muslim terrorists, achieving martyrdom by means of suicide is a way of cleansing the sins and a form of reward. Mortal life is a life encompassed with sin. From the Christian perspective, people are destined to either go to heaven or to hell depending on the sins that have been committed and repented during his or her mortal life. On the other hand, the Islam teaches that through martyrdom, a sinner can redeem himself or herself from the sins that have been done. Participating in a suicide mission is a method to reach self-purification and to be clean from all the sins which will make an individual worthy of the eternal paradise (Pedahzur, 2005, p. 37). Aside from the promise of self-redemption, martyrdom is also use to pose as a reward not just the after-life paradise with Allah but also for family members of the terrorist. Martyrdom is encompassed by the Islamic belief system of ‘jihad’ where the very word has been defined as ‘struggle’ (Habeck, 2006, p. 4). This definition within the context of martyrdom can be said that by means of suicide, to momentarily struggle the pain of inflicting pain or death to the physical body is the path towards eternal happiness. It is a motivation to conclude someone’s life which serves a purpose for the greater good of the Muslim people and for bringing Islam to the top of political power. The Other Purpose of Suicide Terrorism Aside from the strong ideology provided by religion, terrorist groups opted to perform suicide attacks because of practical reasons. Suicide Terrorism has basically became a trend in the new millennium when it comes to attacking opponents. Bruce Hoffman (who specialized in terrorism research stated that suicide attacks are low cost, effective, and cause public attraction (cited in Purpura, 2007, p. 56). Since most of the terrorist factions came from the poverty-stricken countries, if an organization is not supported by an independent financer, suicide attack is a priority to use. Just like Hoffman stated that there is no need for an escape plan (Purpura, p. 56) and the information with regards to the terrorist organization is left as a mystery. Impact of Suicide Attack to Society Since most of the suicide attackers are left unknown, some researchers have estimated profile of suicide bomber. This includes recruits which have an age range from 16-23 years old comprised of mostly single male while female attackers only made up of a small number; and normally members come from different social classes, with the educated leading the faction (Bongar, et al. , p. 106). New Business Plan for a Gas Station Start Up

The customer need that will be satisfied is that my gas station will have gasoline, diesel, and a service station to get the repairs or inspections they will need to have. There will be a free air pump, so they can have the option of filling up their tires. I will also have coffee, snacks and different beverages the customer can purchase as well, so they can also fuel up their bodies as well for the ride they are going to make.The product will be unique by my station having a self service, but also a full service section for customers at no extra cost, but if the customer is getting 5 gallons or less than there will be a slight increase on the price per gallon. I will have two self service gasoline pumps; two full service gasoline pumps that are double sided so that’s make 8 pumps for gasoline. I will have one diesel pump, which the one side will be self service and the other side will be full service.The full service section will have a line on the ground that when they ride over it a bell will ring and the employee will know there is someone waiting to get full service. Along with the full service I will have the employee offer them if they would like their windows to be cleaned, their oil to be checked, and if they would like a beverage or a snack while they are waiting for their fuel. I will also make sure that the pavement is cleaned every day. There will be a canopy to cover the fuel pumps and will make sure there is proper lighting and have some calming music playing while the customer waits.I will have a great color scheme to my gas station to make it stand out. There will be neon lights that will trim the canopy and pumps, so at night it will make it more appealing to the customer and hopefully will draw them in. I will also offer a card that can be scanned at the pump when they pull up that will have a record of their purchases and for every $100. 00 they have spent, not including the service station, I will offer them $. 10 off a gallon. This offer can be accumulated over a month, so depending on how much they spend they can accumulate up to getting $. 0 off a gallon. Though, this offer is only valid for the month pertaining to the purchases they made, so if they do not use the discount then the next month it will be erased and will start over again. The customers that will be coming to my gas station are ones with gasoline, diesel, or even hybrid cars and motorcycles that need to be taken care of. There will even be landscaping and other similar customers coming to filling up their small engines. I will also have customers that will be coming for the service station to get repairs or inspections done to their cars.I will not be able to service 18-wheelers though, but they can still get their diesel. I will also not be able to have a mechanic for motorcycles unless he/she has the proper training along with their automotive training. Their profiles are people who range from the lower upper-class to the middle upper-class. There will be both male and female’s who are coming to the station with their ages being from 18 and up. They’ll be high school and college students along with people who are working and even people who aren’t working that just are getting gas for whatever they are putting the fuel in. In the town my gas station resides, the population is %54. 4 African Americans, %29. 6 Caucasian, %8. 7 Asian American, %4. 3 Hispanic, %2. 4 with two or more races, %0. 2 native Hawaiian and other Pacific islanders, %0. 2 other race, and %0. 1 American Indian, which is a total of 2668 thousand residents† (Advameg, Inc, 2011) These people will be living in the area of my gas station or in the surrounding area of East Lansdowne, PA. They may work in the area at the local stores that surround my gas station. They may work in center city or in the west/south west Philadelphia region.The customer may also work out towards the Springfield mall up Baltimore avenue I may also get people who are going to the gym or going out for the day or night to have a day of fun on the weekend or a day off from their jobs. The customer wants a gas station that will allow them to be in and out as quick as possible so they can continue on with where they are going to go. The customers’ needs are that they feel that this is a place that will take care of them and will treat them with the most upstanding customer service so they will keep on coming back.With the amenities I will provide I will hopefully be going above and beyond their expectations of the service they would receive at another gas station. The customer may need to use the service station, and they’re vehicle will be treated with the proper care it deserves. The Exxon station, located at the corner of Baltimore Avenue and Church lane in East Lansdowne, PA. The Giant supermarket that has a gas station that’s located right by Baltimore avenue and Union avenue in east Lansdowne, PA. The Exxon s tation’s strengths are that they sell cigarettes and have the lottery.They also have a convenience store that you can go inside with an ATM machine in it. Their weaknesses are that there is only one employee that works there. They have an air pump and vacuum section that you have to pay for. They do not have a full service option, nor do they have a service station to work on vehicles or a diesel fuel pump. It also isn’t a very clean or well maintained place. The Giant supermarket’s strengths are that they have the same option of accumulating points from purchases made inside of their supermarket.They also have an entire supermarket that their customers can do their shopping and then head over to the gas pump after with a free air pump as well. Their weaknesses are that in order to get the discount on the gas you have to buy products from their supermarket, whereas at my station the gas is included in the point system. They also do not offer a full service optio n even though there is a gas attendant there to supervise the gas station section. Their other weakness is that the gas station is in the very back of the property so some customer’s may only think there is just the supermarket.They also do not have a service station for repairs, nor do they carry diesel fuel. They Exxon station might try to add a full service feature, but that would be hard with only one attendant there working inside the convenience store. They may to try and make their air pump free for customers. They may also try to add a diesel pump. The Giant supermarket has a little more trouble trying to do a lot of changes because it’s a big company so they’d have to get the OK from the higher ups, but they may also try to add a full service option along with adding the diesel option.I feel neither of them would be able to match the service station part because Exxon has limited room and the Giant probably doesn’t have any intentions of adding t hat because their main focus is the supermarket with the gas being a side thing. â€Å"Sunoco is committed to sustainable business practices. BJ’s sells everything from food and clothing to ga soline and home office supplies. BJ’s also operates an online store. (BJ's Wholesale Club, Inc, 2013) I plan on being an independent gas station and plan on getting my gas and diesel from the Sunoco/Carlyle Group, which is located at 3144 W Passyunk Ave, Philadelphia, PA. I plan on buying my coffee and snacks from BJ’s, which is located at 1260 E. Woodland Ave. Springfield, PA 19064. I do not want to have a franchise with Sunoco, so it will be considered an â€Å"unbranded fuel†. (Sunoco, Inc. , 2013) I expect the relationship with Sunoco/Carlyle Group to be one that I can have a regular set date or dates that they will come and top off what fuels I need.With BJ’s I just expect to pay their â€Å"BJ’s Business yearly payment of $50 to get the items I need, and with the business card I am able to have my items be tax-exempt and have them available for resale. † (BJ's Wholesale Club, Inc. , 2013) The location cost for the property I plan to bu y is $600,000 as is and it’s because it is a closed down gas station. (County of Delaware, 2013) The legalities to having a gas station is that there have to be yearly inspections done by the state to make sure everything is ok.They check the soil for contamination and check to make sure the underground tanks are at the right depth. The state inspectors make sure that each pump is properly working and up to date with the correct parts. â€Å"The ‘U. S. Environmental Protection Agency’ that the pumps are only pumping 10 gallons per minute. † (U. S. ENVIRONMENTAL PROTECTION AGENCY, 1997) They also make sure that all my licenses are up to date and make sure that we are operating under the proper protocols provided by the state. I would want to own and refurbish a facility.There is one at 401 East Baltimore Avenue that has exactly what I am looking for. It was recently a Sunoco station, but all the Sunoco signs and words have been taken down so it looks like a blank slate. It has a three car garage with the lifts still in it and an air pump already in place. The only thing I would have to add is the diesel pump to the facility and to have the underground tank for the diesel to be placed in. I would have to have someone come out and make sure that the pumps work and have someone come in and check out the lifts in the garage to make sure they are up to par as well.I will purchase any necessary parts that the maintenance guys found wrong with the pumps and the lifts in the service station. I will have to purchase the line that runs on the ground for the full service section of the gas station to let the employee know the customer is there. I will also have to invest in the tools required for the service station so that the employees have the proper equipment needed to work on the vehicle. I need to have the signs and all the proper naming of my gas station placed on the property along with the neon lighting. I will purchase the speakers tha t will be playing the calming music for the customers.I will have to get the proper licensing from the state to be able to give inspections to vehicles. I will be open 7 days a week from 5am until 11pm, but the service station will only be open from 8am until 8 pm. I will need to have an employee who is in charge of the cash register and assigning the gas to the right pump. I will need to have a mechanic that will take care of the service station. I will need to hire an employee that can take care of the full service part of the gas station. I will have at least 2 to 3 cashiers that will be able to work part-time shifts.I will need to have at least 2 to 3 mechanics that will be able to work part-time or full-time shifts, but only will need one mechanic available during each shift. If there are days that the service station is overloaded with cars I may need to call in one of the other mechanics to come in and help out. I will need at least 2 to 3 part-time employees that will need t o be in charge of the full service section, but will only need one employee at a time during the shift. I will also be at the gas station from time to time to make sure things are the way they are supposed to be.The cashier person will need to be able to work the cashier and be able to set the right amount of gas to the right pump for the customer with the proper customer service skill to keep the customer happy. The cashier will also have to differentiate whether the person is at the self service or the full service station to make the right adjustments in prices and know about the 5 gallon or less rule. The mechanics will have to give me a proper resume or some sort of certification that they are real mechanics and are able to work on different brand vehicles.The mechanic should be responsible for removing, installing, diagnosing, repairing, disassembling and assembling parts, components and engines while performing all duties according to safety procedures. (Salary. com, 2013) Th e mechanics should know how to properly approach the customer and kindly ask them what it is they need. The employee in charge of the full service station is going to need to be properly dressed in a uniform; while wearing a new pair of gloves for every customer they service.The full service employee will also need to know how to clean the windows properly and be able to check to make sure the oil level is correct in the car if they are asked to check for that. The full service employee will also need to have the best customer service skills to keep the customer pleased and will need to be able to communicate with the cashier on what their total will be when they are asking if they can get the customer a beverage or a snack while the customer waits to be fueled up. The cost of the cashier position per hour will be $8. 00 an hour with the potential to gain a raise every 6 months. (Salary. om, 2013) The mechanics will be working for $18. 00 an hour and also have the potential to get a raise every 6 months and/or if they show they work at a fast rate with quality work being done. Last year, Vittorio Calao, the CEO? of Vodafone received around ? 0m for remuneration in fiscal year 2012, which is one of the highest remuneration in the FTSE 100 [4]. Although the executive rewards are higher than others in the FTSE 100, there still are 96. 12% shareholders voting in favour with the Vodafone’s remuneration policy [5]. This raises the question that why there are a huge amount of shareholders convincingly supports their highest r emuneration. This essay analyses the executive remuneration for Vodafone Group. Firstly, it will talk about the remuneration principle. Then the Remuneration Committee will be discussed.This part aims to measure whether the Remuneration Committee according to the UK Corporate Governance Code. The third part will explain the remuneration package of Vodafone Group, both base salary and various bonuses are included. At last, the essay will discuss the rationality of Vodafone’s executive remuneration from the perspectives of remuneration policy itself and the comparison with other companies. 2. Remuneration principle The aim of Vodafone’s executive remuneration is driving executives to achieve the company’s long-term strategic goals by offering an attractive and competitive reward [6].Vodafone wishes to make sure that their executive directors keeping in the highest level in work by providing an attractive payment. For example, a part of rewards are measured by the performance for this year. Therefore, executive directors were given an opportunity to achieve the truly exceptional performance. The remuneration package is determined by Remuneration Committee after Comprehensive consideration. The Remuneration Committee will choose some relevant group of comparators when setting total reward. It makes sure that the executive remuneration policies are considered on a total compensation basis.The comparators are choosing from some basic considerations, which are as follows: 1) top European companies, 2) top UK companies, 3) particularly for scarce skills, and 4) the relevant market in question [6]. These comparators mean that Europe is the major region for business for Vodafone, and the company is original from UK. According to above three principles, the external comparators are consisting by similar size companies, and the European top 25 companies and a few other select companies relevant to the sector.Additionally, the external comparator group do not including the financial companies, such as bank and insurance company. Another important Remuneration principle is that the rewards will related to the performance both long-term and short-term. According to the Annual Report of 2012, performance-based reward account for 70% in the whole remuneration package [6]. Vodafone build a link between executive directors and shareholders by this way, in order to force executive directors think about shareholders’ interest. 3. Remuneration CommitteeAccording to the UK Corporate Governance Code, the Remuneration Committee must include at least three independent non-executive directors [7]. The Remuneration Committee of Vodafone is consisting by independent non-executive directors and running independently in the company. The chairman of Remuneration Committee is Luc Vandevelde, and there are another five members in the Remuneration Committee. All of them are the non-executive directors in company. There also are two external adv isors: PricewaterhouseCoopers LLP (‘pwc’) and Towers Watson.Pwc is responsible for performance analysis and giving suggestions about company strategy and measuring the performance. It also supports the international business of Vodafone, such as tax, finance, compliance and operations. Another external advisor Towers Watson provides the market data of executive payment to Remuneration Committee. They also manage the pensions and benefit for Vodafone [6]. There are a lot of factors need to be considered by Remuneration Committee when deciding the payment package. Firstly, Remuneration Committee consults the CEO and HR directors’ opinion of the appropriate reward package for executives.Secondly, the external advisors give the Committee another perspective form the external information analysis. They can provide the benchmark of directors’ reward about other similar company on the market. Additionally, Committee also take the company’s strategy into ac count, both long-term and short-term are important. In fiscal year 2012, Remuneration Committee had five meetings to discuss the Short-Term Incentive bonus, Long-Term Incentive plan and basic salary in order to determine the total remuneration packages of the executive directors appropriately [6].Remuneration Committee particularly report four chief executive directors in the Directors’ Remuneration Report, including Chief Executive Vittotio Colao, Chief Financial Officer Andy Halford, Chief Technology Officer Stephen Pusey and Regional CEO Europe Michel Combes, and the reporting also include the reward of non-executive directors. 4. Remuneration package The Vodafone remuneration package is divided into five parts: base salary, Global Short-Term Incentive Plan (‘GSTIP’), Global Long-Term Incentive Plan (‘GLTI’) base awards, Global Long-Term Incentive Plan (‘GLTI’) co-investment matching awards and benefit [6].These parts reflect the remu neration policy of Vodafone which make the executives holing a lot of company shares to align the interest of executive directors and investors. It also obeys the UK Corporate Governance Code that keeping the reward in a level which is attractive and motivate to the directors, and designing the performance- related income based on long-term strategy. Base salary aims to attract and retain the best talents. It reflects the directors’ level of skill, experience and the responsibility in Vodafone. In fiscal year 2012, Committee decided the base salary stay at the same level with 2011[6].Global (‘GSTIP’) measure the performance in this financial year with the short- term financial and non- financial target, and the GSTIP is paid in cash in June 2013. The related performance is service revenue (25%), EBITDA (25%), adjusted free cash flow (20%) and competitive performance assessment (30%). This bonus can flow from 0-200% of base salary, and it reward 93. 4% of target f or financial year 2012[6]. Global Long-Term Incentive Plan (‘GLTI’) is consist of performance shares which award every year and vest three years later to force directors on the Vodafone’s long-term strategy.The vesting of performance shares is determined by the adjusted free cash flow and relative TSR performance. Both operational performance and external performance are included in the two measures in GLTI. The target GLTI face value of CEO is 137. 5% for basic salary, and 110% for other directors. In this year, executive directors was rewarded the vesting the shares of 2008 fiscal year at 30. 6% of maximum [6]. Global Long-Term Incentive Plan (‘GLTI’) co-investment matching awards means that executive directors can purchase Vodafone normal shares and turning them to performance shares after holding three years.Benefit is the pension scheme for the executive director and other benefit such as company car and private medical insurance. 5. Analysis of the director remuneration Figure 1 Total remuneration for 2012 (based on Vodafone 2012 Annual Report) The Figure 1 shows the detail of the total remuneration for fiscal year 2012 including a value for GLTI payment. Without the GLTI vesting during this year, Vodafone actually paid 30. 35m pounds to CEO Colao, 19. 27m pounds to CFO Halford, 21m pounds to Europe region CEO Combes, and 14. 08m pounds for CTO Pusey [6].The Figure 1 illustrates that all the four chief executive directors’ incomes are increasing except the CTO Pusey. Although the total rewards were general increased, GSTIP for fiscal year 2012 was decreasing. In the meanwhile, salary and cash in lieu of pension were keeping in the similar level with last year. Therefore, the increasing of total remuneration was due to the significant increasing of the item cash in lieu of GLTI dividends. During the fiscal year 2012, the Global Short-Term Incentive was deduct from last year. The total actual short term incentive pay ment was 93. %, while the target payment is 100% and the maximum payment is 200% for the basic salary [6]. According to the remuneration policy of Vodafone, GSTIP is influenced by the performance for this year. There are four indicates to measure the GSTIP: service revenue, EBITDA, adjusted free cash flow and competitive performance assessment. According to the 2012 annual report, the service revenue slightly increased to 46. 4bn pounds, which was just arrival the target performance [6]. However, the EBITAD and adjust free cash flow were cut down, especially the adjust free cash flow.Because of the loss of China Mobile Limited and the dividends of SFR, the actual pay-out percentage for adjust free cash flow is 8. 5, while the target performance is 20% in the whole GSTIP [6]. The policy of GSTIP is related to both the financial and non-financial performance in this year in order to measure the executive short-term performance in a rational way. The target performance is not only base d on the Vodafone’s strategy and past operation, but also taking the long-term strategy into account. The GLTI is determined by adjust free cash flow and the TSR outperformance of a peer group median. These two indicators consist a matrix in order to measure the internal operational performance and external performance. The long-term operation cycle is three years which means the target performance of financial year 2012 was settled in 2010.According to Figure 2, the target for 2012 is 18bn pounds, while the actual adjusted free cash flow for 2012 was 20. 9bn pounds [6]. Another important measure is the TSR performance. The figure 3 shows that Vodafone’s TSR was outperformance than the peer group which c onstitute by the similar size companies. The TSR performance increasing by 18. 5% in 2012, and exceed the target number. From this figure, it indicates that Vodafone’s TSR performance is higher than the average level of FSTE 100.It means that the Vodafone Group is in a better operation situation among FSTE 100 companies. Therefore, it is reasonable that Vodafone’s executive remuneration is higher than the similar size companies. Additionally, the comparison in Table 1 is shown in similar result. BT Group is another strong competitor of Vodafone in UK telecommunication industry. The numbers in table 1 are published in the annual report for the two companies from 2010 to 2012. The total revenue of Vodafone is basically twice as much as BT Group, while the difference between the CEO remuneration is just around ? m in the three years. Through above analysis, Vodafone remuneration is in a rational level, and it is corresponding to its operation performance. 6. Conclusion All in all, Vodafone executive remuneration is acceptable and in a rational level. It not only reflects the operation performance but also obey the rules of UK Corporate Governance Code. The executive remuneration is setting by an independent remuneration committee which consist by five non-executive directors and two external advisors.The remuneration report is published by Remuneration C ommittee in Vodafone’s Annual Report. The remuneration package divide into base salary, Global Short-Term Incentive Plan (‘GSTIP’), Global Long-Term Incentive Plan (‘GLTI’) base awards, Global Long-Term Incentive Plan (‘GLTI’) co-investment matching awards and benefit. Through these five parts, executive reward is related to performance and the investor interest, and can help executives focusing on company’s strategy. Therefore, Vodafone executive remuneration can be seen as a good example in executive remuneration policy.
